These Terms of Service ("Terms") govern your access to and use of GunCollector (the "Service"), operated by GunCollector.com LLC ("we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
GunCollector is a personal inventory and record-keeping tool that lets users track firearms, ammunition, accessories, maintenance history, and range trips that they report themselves. The Service is a record-keeping convenience only. It is not a system of record for any government agency, does not verify ownership or legal status of any item you enter, and does not facilitate the sale, transfer, or acquisition of firearms or ammunition.
You must be legally permitted to possess firearms and ammunition under the laws that apply to you — including federal law and the law of your state, province, or locality — in order to use the Service to record such items. You are solely responsible for knowing and complying with those laws, which vary by jurisdiction and change over time. Creating an account, or checking the "I agree to the Terms" box, is your representation that you meet this requirement.
We do not run background checks, verify permits or licenses, or otherwise confirm that any individual user or item entry complies with applicable law. Nothing about the existence of an entry in your GunCollector inventory implies that the underlying item, or your possession of it, is lawful.
You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Tell us promptly if you suspect unauthorized access. You must provide accurate information when creating your account and keep it up to date.
You agree not to use the Service to store or transmit unlawful content, attempt to gain unauthorized access to other accounts or to our systems, interfere with the normal operation of the Service, or use it in any way that violates applicable law, including firearms and ammunition laws.
You retain ownership of the information you enter into GunCollector (item details, photos, notes, and similar records — "Your Content"). You're solely responsible for the accuracy of Your Content. We store it in order to provide the Service back to you, and we don't sell it to third parties. For details on what we collect and how it's used, see our Privacy Policy.
Nothing in the Service — including any labels, categories, reminders, or reference information it displays — constitutes legal advice regarding firearms ownership, transport, storage, or transfer. Laws in this area are complex, vary by state and locality, and change frequently. Consult a qualified attorney or your local law enforcement agency for authoritative guidance on your specific situation.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA YOU STORE WILL NEVER BE LOST.
TO THE FULLEST EXTENT PERMITTED BY LAW, GUNCOLLECTOR.COM LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that creates risk or legal exposure for us or other users.
We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to notify you (for example, by email or an in-app notice) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
